West Linn's Planning Commission will vote on the 320-unit residential portion of the Tannler Drive mixed-use development at a special meeting Wednesday, Aug. 26, at 6 p.m. in City Hall's Council Chambers.
No public testimony will be taken.
The city's agenda, posted Aug. 18, lists a single substantive item: deliberation and decision on the design review and lot line adjustments for properties at 2410, 2422 and 2444 Tannler Drive and 1800 Blankenship Road. The case number is DR-25-04/LLA-25-02. Staff liaison is planning manager Darren Wyss.
Under Oregon House Bill 4037 and Senate Bill 974, which took effect July 1, the city did not hold a public hearing on the housing portion. Written testimony closed at 4 p.m. Aug. 5. Only the applicant, not neighbors, may appeal the residential decision.
"Given the scope of this project, I think cutting deliberations short is not prudent," Planning Commissioner Kris Kachirisky said at the Aug. 10 hearing, explaining the commission's decision to defer rather than rule that night.
The project, filed by Tannler Holdings LLC, whose principal is landowner Jeff Parker, would build 10 apartment buildings across 11.4 acres on a hillside above I-205 overlooking the Willamette River. Four buildings would include ground-floor commercial space totaling 11,630 square feet, and the site plan calls for 400 parking spaces plus street parking. West Linn has no parking minimums in its development code.
According to OPB, planning manager Wyss said the last time a development of 45 or more homes was approved in West Linn was nine years ago. The city hasn't seen a new multifamily project since the late 1990s.
Attorney Andrew Mulkey, representing residents Ed and Roberta Schwarz, argued in a July 9 letter to the city that the new state laws deny neighbors their right to pursue judicial review of local land-use decisions. The Lake Oswego Review reported that West Linn City Attorney Kaylie Klein wrote to the applicant's attorney July 8 confirming the city would hold a public hearing on the commercial aspects but not on the housing components.
